Welcome to Four Little Acres! The terms "we," "us," and "our" refer to Four Little Acres. Four Little Acres operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Four Little Acres is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access the Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given consent to allow your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing information, payment information, delivery address, and other order information.
You represent that the information you provide is accurate, current, and complete and that you have the right to provide this information.
You are responsible for maintaining the security of your account credentials and for activity occurring through your account.
SECTION 2 – OUR PRODUCTS
Four Little Acres offers homemade, home-produced, locally sourced, and/or seasonal food and agricultural products.
We make every reasonable effort to accurately represent our products on our website. However, because many of our products are handmade or naturally grown, individual products may vary in size, shape, color, appearance, texture, or other characteristics from photographs shown online.
Seasonal produce is subject to natural growing conditions, weather, harvest availability, quality at the time of fulfillment, and other factors outside our control.
Product availability may change at any time. We reserve the right to limit quantities, discontinue products, or mark products unavailable when inventory or harvest conditions require it.
When a seasonal assortment, Harvest Box, Homestead Box, or similar product is purchased, the exact produce included may vary based on what is available and ready to harvest. If an advertised item becomes unavailable before fulfillment, we may substitute another available item of approximately comparable value when reasonably appropriate.
We reserve the right to discontinue any product or limit quantities available to any person or geographic area.
SECTION 3 – FOOD PRODUCTS AND ALLERGEN INFORMATION
Four Little Acres sells food products, including homemade baked goods and other food products.
Products may contain or come into contact with common food allergens, including but not limited to wheat, gluten, eggs, milk, soy, peanuts, tree nuts, and other ingredients.
Customers with food allergies, sensitivities, or dietary restrictions are responsible for reviewing available ingredient and product information and contacting Four Little Acres with questions before purchasing or consuming a product.
Because products may be prepared in a kitchen or environment where multiple ingredients are handled, we cannot guarantee that any product is completely free from cross-contact with allergens unless expressly stated.
Certain products sold by Four Little Acres may be produced in a home kitchen or otherwise sold under applicable Missouri laws governing homemade or cottage food products. Products should be stored, handled, and consumed according to any instructions provided with the product.
SECTION 4 – ORDERS
When you place an order, you are making an offer to purchase products from Four Little Acres.
We reserve the right to accept, decline, modify, or cancel an order when reasonably necessary, including because of product availability, harvest conditions, inventory errors, payment issues, suspected fraud, or other circumstances affecting our ability to fulfill the order.
Your order is considered accepted once payment has been successfully processed and your order has been confirmed.
Please review your order carefully before submitting it.
Because many Four Little Acres products are fresh, perishable, harvested specifically for weekly orders, or baked to order, cancellation requests may not be accommodated once preparation, baking, harvesting, or fulfillment has begun.
If we are unable to fulfill an item you purchased, we may contact you regarding a substitution, store credit, refund, or other appropriate resolution.
Purchases are also subject to our Return and Refund Policy.
SECTION 5 – PRICES AND BILLING
Prices, discounts, product availability, and promotions are subject to change without notice.
The price charged for a product will generally be the price displayed at the time the order is placed and will appear in your order confirmation.
Any applicable taxes, delivery charges, or other charges will be displayed at checkout when applicable.
You agree to provide current, complete, and accurate purchase, payment, and account information for purchases made through our store.
You represent that you are authorized to use the payment method provided and agree to pay all charges associated with your order.
SECTION 6 – LOCAL DELIVERY AND PICKUP
Four Little Acres primarily serves customers through local delivery and/or porch pickup.
Local delivery is available only within areas currently served by Four Little Acres. Availability may vary based on location, route capacity, order volume, weather, road conditions, and other circumstances.
Any delivery date, delivery window, or estimated arrival time provided through the website or in communications from us is an estimate unless we expressly state otherwise.
Customers are responsible for providing a complete and accurate delivery address and any information reasonably necessary for us to locate the delivery location.
When an order containing perishable food is delivered to the address provided by the customer, responsibility for promptly retrieving, refrigerating, storing, or otherwise properly handling the products passes to the customer.
Four Little Acres is not responsible for spoilage, deterioration, theft, weather exposure, animal interference, or other damage occurring after an order has been successfully delivered to the address provided by the customer.
For porch pickup orders, customers are responsible for retrieving their order within the pickup timeframe communicated by Four Little Acres.
Orders not retrieved within the appropriate timeframe may be subject to product quality or food-safety concerns due to the perishable nature of the products.
SECTION 7 – PRODUCT AVAILABILITY AND SUBSTITUTIONS
Many products sold by Four Little Acres depend on seasonal harvests, weather, animal production, ingredient availability, and other factors that may change unexpectedly.
We fulfill orders based on available inventory and may prioritize orders based on when they were received.
If an item becomes unavailable after an order is placed, Four Little Acres may, when reasonably appropriate:
• Substitute a comparable product or combination of products of approximately equal value;
• Contact the customer to select an alternative;
• Issue a credit or refund for the unavailable item; or
• Make another reasonable arrangement with the customer.
For seasonal produce boxes and assortments, customers acknowledge that exact contents may vary from photographs, examples, or preliminary descriptions.
SECTION 8 – INTELLECTUAL PROPERTY
Our Services, including our business name, branding, photographs, graphics, written content, product descriptions, videos, logos, designs, and other original materials, are owned by Four Little Acres or their respective licensors and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial purposes.
You may not reproduce, distribute, modify, republish, sell, or commercially exploit our original materials without prior written permission.
Four Little Acres names, logos, product names, designs, and slogans may not be used without permission.
Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. Other names and trademarks appearing through the Services belong to their respective owners.
SECTION 9 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES
You may be provided access to tools or services offered by third parties as part of the Services.
We may not monitor or control these third-party tools.
Your use of optional third-party tools is at your own risk and discretion, and you should review the applicable terms and privacy practices of the provider.
We may offer additional features, tools, or resources through the Services in the future. Such features will also be considered part of the Services and subject to these Terms.

Four Little Acres is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Four Little Acres.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Four Little Acres, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Four Little Acres.
SECTION 12 – PRIVACY POLICY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information regarding your access to and use of the Services in order to provide and improve the Services.

We do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.
We make reasonable efforts to accurately describe and represent our products. However, naturally grown and handmade products may vary from photographs or descriptions.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded under applicable law.
SECTION 18 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, FOUR LITTLE ACRES AND ITS AFFILIATES, SERVICE PROVIDERS, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Four Little Acres, Shopify, and their respective affiliates, employees, agents, contractors, licensors, and service providers from third-party claims arising from your material breach of these Terms, violation of applicable law, violation of another person's rights, or misuse of the Services.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed as necessary.
The remaining provisions will continue in full force and effect.
